Terms and Conditions

UCPolynesia – Hawaiian Tours, in association with Utah Community Planners (UCP), is acting as an agent for suppliers of air and ground transportation, hotel accommodations, meals, tours, cruises, etc. in selling travel-related services, or in accepting reservations or bookings for services that are not directly supplied by UCP. UCP attempts to represent only those suppliers of travel that have shown an acceptable level of stability, dependability and responsiveness to problems and complaints. Nevertheless, UCP does not control the actions or failure to act of the suppliers it represents. Therefore, UCP shall not be responsible for any breach of contract, failure to comply with any such laws as the Americans with Disabilities Act (ADA), or any intentional or negligent actions or omissions on the part of such suppliers, which result in any loss, damage, delay, inconvenience or injury to travelers or travelers companions or group members, including any losses resulting from any changes in suppliers rates, unless marked on your invoice, tickets, or reservation itinerary as Guaranteed, or any losses in connection with booking, reservation, connection, or scheduling problems or in connection with the handling or loss of baggage or other personal effects. UCP shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or deficiencies, diseases, local laws, climactic conditions, abnormal conditions or developments, or any other actions, omissions, or conditions outside of UCP’s control.

Traveler assumes complete and full responsibility for checking and satisfying himself or herself with respect to safety and security conditions of UCP travel destinations. By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of the above risks as well as possible travel industry bankruptcies, climactic disruptions, natural disasters, civil unrest, terrorist activities, and the possibility traveler may be unable to travel as scheduled because of personal emergency or medical problems, etc. Traveler is advised to obtain appropriate insurance against these risks. Information is available through UCP regarding travel insurance. Traveler’s booking of reservations or utilization of tickets after receipt of this information will constitute a consent to the above and an agreement on his/her part to provide copies hereof to his/her travel companions or group members together with an explanation that if they embark, they do so subject to these conditions and responsibilities.

Payments & Cancellations: A 50% payment of total cost is due 60 days prior to departure. Final payment is due 30 days prior to departure. In certain circumstances, it may be required earlier. Participant cancellations prior to 60 days from departure, deposit will be refunded less $50 per person. Cancellations received 60 to 30 days prior to departure will be subject to a cancellation penalty of $100 per person, plus any assessed by the airlines, hotels or other suppliers. For cancellations received after 30 days prior to departure, or if you should have to leave the tour unexpectedly once it has commenced, a refund will be subject to any funds that can be recovered from suppliers. The purchase of this tour is the purchase of a complete tour package; therefore, no refunds will be made for individual components or activities on the tour not used or participated in. We strongly recommend the purchase of travel insurance for your protection.

Travel Documents: Final travel documents will be mailed or delivered two weeks prior to departure. Included are instructions, air schedule, hotel lists, and other pertinent information at that time. Please notify us if you have a change of address.
